SMS Terms of Service

These SMS Terms of Service ("SMS Terms") govern your enrollment in and use of text messaging services ("SMS Service") provided by Mindspirit LLC d/b/a TruePresence ("TruePresence," "we," "us," or "our") in connection with the TruePresence platform. By providing your mobile phone number and opting in to receive text messages from TruePresence, you agree to these SMS Terms in addition to TruePresence's Terms of Service and Privacy Policy.
1. Program Description
TruePresence offers a text messaging service to support account security and authentication for users of the TruePresence platform. The SMS Service is used to deliver:
- Two-factor authentication (2FA) codes required to verify your identity when signing in or performing sensitive account actions.
- Account security alerts, such as notifications of new device sign-ins, password changes, or suspicious activity on your account.
- Verification codes when adding or changing security settings (e.g., recovery phone number, password reset).
The SMS Service is transactional in nature. TruePresence does not send marketing, promotional, or advertising messages through the SMS Service.
2. How to Opt In
You may enroll in the SMS Service by:
- Providing your mobile phone number during account registration on the TruePresence platform and affirmatively electing to receive 2FA codes via SMS, or
- Adding or enabling SMS-based two-factor authentication from your account security settings after registration.
By providing your phone number and affirmatively enabling SMS-based authentication, you consent to receive recurring, automated text messages from TruePresence at the number provided. Consent to receive these messages is not a condition of purchasing any goods or services, except that SMS-based 2FA itself requires SMS delivery; you may instead choose authenticator-app-based 2FA or another supported method.
3. Message Frequency
Message frequency varies and depends on your account activity. You will generally receive a text message only when you (or someone using your credentials) take an action that requires verification — for example, signing in, resetting your password, or changing security settings.
4. Message and Data Rates
Message and data rates may apply. Standard message and data rates charged by your wireless carrier will apply to each message sent or received. TruePresence does not charge for participation in the SMS Service, but your carrier may. Check your mobile plan or contact your carrier for details.
5. How to Opt Out
You may opt out of the SMS Service at any time by replying STOP to any text message you receive from TruePresence. You may also reply END, CANCEL, UNSUBSCRIBE, or QUIT — all of these will cancel your enrollment.
After you opt out, you will receive a final confirmation message confirming that you have been unsubscribed and will not receive further messages.
Important: If you opt out of SMS, you will no longer be able to receive 2FA codes via text message. You will need to switch to an alternative 2FA method (such as an authenticator app) to maintain two-factor authentication on your account. If you do not, your account may be subject to alternative security verification steps.
To re-enroll, you may reply START or re-enable SMS-based 2FA from your account security settings.

7. Supported Carriers
The SMS Service is available on most major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, Boost, Cricket, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.
8. Eligibility
You must be at least 18 years of age, or have the consent of a parent or legal guardian, to enroll in the SMS Service. You represent that the mobile phone number you provide is yours, that you are authorized to enroll that number, and that you will notify TruePresence promptly if the number is no longer assigned to you.
9. Privacy
Your privacy is important to us. Information collected in connection with the SMS Service is handled in accordance with the TruePresence Privacy Policy. No mobile information collected for the SMS Service — including your phone number and consent to receive messages — will be shared with third parties or affiliates for marketing or promotional purposes. Because TruePresence is a healthcare platform subject to the Health Insurance Portability and Accountability Act ("HIPAA"), TruePresence does not transmit Protected Health Information (PHI) via SMS. SMS messages are limited to authentication codes and account security notices that do not contain PHI.
10. Changes to These SMS Terms
TruePresence may modify these SMS Terms from time to time. We will post the updated SMS Terms on our website and update the "Last Updated" date above. Material changes will be communicated to enrolled users where required by law. Your continued enrollment in the SMS Service after the effective date of any change constitutes acceptance of the revised SMS Terms.
